dc.description | El neoconstitucionalismo es una teoría jurídica que nos ubica frente a un Estado cuya finalidad es la de respetar y garantizar los derechos fundamentales de los individuos, en todos los escenarios que nos presenta la realidad actual. A pesar de que el neoconstitucionalismo se desarrolló hace décadas en la Europa posbélica, esta teoría llega a América Latina de manera tardía y logra consolidarse, como la respuesta adecuada a las demandas de grupos sociales y de colectivos, que exigían un cambio en la legislación, en la justicia y un verdadero reconocimiento a sus derechos. En el Estado Constitucional de Derechos Ecuatoriano, el desarrollo de esta corriente jurídica es evidente a partir del proceso constituyente que inicio en el país desde año 2008 con la elaboración de la Constitución de la Republica, la cual marco el inicio de un desarrollo normativo y una actividad jurídica progresista, enfocada en la defensa de la Constitución y en la protección de los derechos fundamentales. | es_ES |
dc.description.abstract | Neo-constitutionalism places us in front of a state whose final purpose is to respect and to guarantee the fundamental rights of every human being, despite of the scenarios and challenges that our current reality presents us. Although neo-constitutionalism developed in Europe decades ago, it arrived into Latin America belatedly and achieved an important consolidation, as the appropriate answer to the claims of social groups and collectives that required for changes in the legislature, the justice system and a true recognition of their rights. In our Constitutional State of Rights, the development of this legal stream is notorious since the constituent process that began in 2008 with the validity of the Constitution of the Republic, which led to a progressive regulatory and jurisprudential development, focused on the Constitution and on human rights. | es_ES |
