| dc.description | Desde 1938 en materia de estupro, como delito regía el Código Penal Ecuatoriano, pero el 10 agosto de 2014 se derogó este código, al promulgarse el Código Orgánico Integral Penal, este último considera cambios importantes en los elementos constitutivos del delito de estupro. El objetivo de este trabajo es realizar un análisis comparativo sobre el contenido entre el Código Penal y el COIP en relación al delito tipificado como estupro, para ello se revisó sus normas a fin de establecer las diferencias relativas al sujeto activo, sujeto pasivo y del bien jurídico tutelado. Sin embargo, no se encontraron cambios concernientes a estos elementos, pero si referentes a la cópula y los medios de ejecución, y su sanción; así la pena en caso del cometimiento del delito que anteriormente está tipificado de 3 meses a 3 años, en la actualidad estipula que será sancionada con 1 a 3 años; respecto a la forma y medio de ejecución del delito como es la seducción y engaño; en el anterior Código expresaba estos dos términos y en la actualidad segrega al término seducción, cuya omisión puede acarrear actos de impunidad a la hora de juzgar un hecho en el que esté involucrado este elemento, y en cuanto al verbo rector, deja de ser cópula y se establece actualmente como relación sexual. | es_ES |
| dc.description.abstract | Raping has been considered a felony by the Ecuadorian Criminal Code since 1938, but since August 10th 2014 this code was repealed and the new Integral Organic Criminal Code considers important changes to the constitutive elements of the felony of raping. The objective of this research is to present a comparative analysis of the contents of the Criminal Code and COIP (Spanish acronym) related to raping. For this purpose the corresponding laws were reviewed in order to establish differences related to the active subject, passive subject and good guardianship. Nevertheless, we didn’t find changes regarding this elements but references to copulation and means of execution and their punishment; so in case of consent of the above mentioned felony the punishment was between 3 months to 3 years and currently with the new code it is between 1 to 3 years. The previous Code used two terms and currently it is segregated to the term seduction, which omission can produce impunity at the trial time when this fact is involved and regarding the rector verb it is not considered copulation but sexual intercourse. | es_ES |
