| dc.description | El procedimiento monitorio viene del latín monitoriusque lo podemos entender de manera similar a la persona que avisa o amonesta, en consecuencia es el llamado de advertencia que hace el juzgador al deudor. El Código Orgánico General de Procesos prevé este procedimiento nuevo para la legislación ecuatoriana a través de la cual el juzgador intima al demandado para que cumpla con la o las obligaciones reclamadas, por medio de un auto interlocutorio. Pudiendo el obligado justificar el cumplimiento de la obligación de las maneras previstas en la ley, o en el caso de no hacerlo, dicho auto interlocutorio causa ejecutoria, a consecuencia de la no comparecencia o inactividad. En el supuesto de que el deudor cumpla con la obligación el juzgador lo sentará en autos y dispondrá el archivo. | es_ES |
| dc.description.abstract | The monitorio procedure comes from the Latin “monitorius” that we can understand similar to the person who warns or admonishes, in consequence it is the call of warning that makes the judge to the debtor. The CódigoOrgánico General de Procesosforesee this new procedure to the Ecuadorian legislation through which the judge intimates the defendant to fulfill with the obligation or obligations complained, through an auto interlocutorio. Being able the required to justify the fulfill of the obligation by the ways provided by law, or in the case of not doing, the auto interlocutorio cause executory, in consequence of the non-appearance or inactivity.
