| dc.description | La presente investigación y estudio tiene como finalidad determinar las causas jurídicas por las cuales, un acta de finiquito puede ser invalidada, y establecer las situaciones o particulares que no hayan podido ser resueltos entre patrono y trabajador, mediante la suscripción del mencionado documento ante el Inspector del Trabajo; situaciones que pueden ser discutidas y solventadas en la vía judicial;todo esto,fundamentados en lasnormas de nuestro actual ordenamiento jurídico, doctrina y jurisprudencia, que nos permitirá justificar con precisión las pretensiones planteadas, con el fin de garantizar los derechos tanto del trabajador como del empleador. Analizaremos las normas vigentes del Código del Trabajo, respecto del acta de finiquito y el Código Civil, en relación al contrato de transacción, ya que su asimilación a este acto jurídico, nos permitirá vislumbrar las posibles situaciones en las que procedería la impugnación del documento de finiquito, considerándolo como tal, situación por la que nos remitiremos a examinar este último cuerpo normativo, en donde encontraremos las disposiciones que regulan este contrato y las causas que motivan su invalidez. | es_ES |
| dc.description.abstract | This research study aims to determine the legal reasons for which a certificate of settlement may be invalidated and set situations or individuals that have not been resolved between employer and employee, by signing the document referred to the Inspector Job; situations that can be discussed and eliminate with in the courts; all this, based on the rules of our current law, doctrine and jurisprudence, which will allow us to justify the claims made precisely in order to guarantee the rights of both the employee and the employer. Analyze the current regulations of the Labour Code, regarding the minutes of settlement and the Civil Code, in relation to the transaction contract, as their assimilation into this legal act, it allows us to glimpse the possible situations in which proceed the settlement document impugnation,considering it as such, a situation we refer you to examine this last legislative body, where we find the provisions governing this contract and the reasons for his disability | es_ES |
