| dc.description | La prescripción liberatoria o extintiva de acciones es un modo legal y constitucional de extinguir las obligaciones. El tiempo y la inacción del titular del derecho afectado constituyen sus condiciones básicas. Declarada la prescripción, la obligación se transforma en natural. Esta institución se fundamenta en aspectos de orden público y social vinculados con la necesidad de seguridad jurídica. La prescripción extintiva se la alega generalmente como excepción al momento de contestar la demanda, mas se la puede deducir como acción y aún como incidente. En nuestro ordenamiento jurídico existen prescripciones de corto, mediano y largo tiempo, así como también acciones imprescriptibles en razón de la tutela a mas altos derechos o bienes jurídicos. Se encuentran reguladas en la Constitución, pero tienen mayor presencia en códigos como el C. Civil y el COIP, por lo que, mas son las acciones legales prescriptibles que las constitucionales. De igual forma, más son las acciones constitucionales imprescriptibles, que las legales, en miras a garantizar derechos fundamentales. Su excesivo número provoca inseguridad en Jueces, Abogados y ciudadanos, por lo que es conveniente reducir su número, simplificarlos y estandarizarlos. | es_ES |
| dc.description.abstract | The liberatory action or statute of limitations is a legal and constitutional way to extinguish the obligations. The time and the inaction of the right holder concerned constitute basic conditions. Declared the prescription, the obligation becomes natural. This institution is based on aspects of public and social order linked to the need for legal certainty. The statute of limitations is generally alleged as the exception at the moment of answering the demand, but it can be deducted as an action and still as an incident. In our legal system requirements exist prescriptions of short, medium and long term, as well as inalienable actions to guardianship higher duties or legal interests. They are regulated in the Constitution, but they have a greater presence in codes like the Civil C. and the COIP, reason why, and are more the legal prescriptible actions than the constitutionals. Likewise, most are the inalienable constitutional actions, than the legal, in order to ensure fundamental rights.
