Los delitos laborales y la responsabilidad penal del empleador

Abstract

Many are the countries that have considered the need for the legislation and the inauguration of an efficient regulatory framework for penal labor, whose discussion and legislative activity should not be exempted on Ecuador. There are numerous risks emanating from certain labor relations, many of which are not considered in our legislation, namely the tutelage and protection of fundamental rights at work that is inadequate in the current Ecuadorian legislation. Therefore, in this study, and after analyzing international conventions of the International Labour Organization (ILO), relating to fundamental labor rights, the Constitution of the Republic, The Code of Criminal Integral, Labor Code and Comparative Law, we wish to present a proposal to create new criminal offenses that undermine labor rights in Ecuador.
