| dc.description | El presente trabajo tiene como finalidad, determinar cuál es el órgano competente para otorgar la titularización y consecuente dominio de los bienes vacantes o mostrencos en el Cantón Cuenca, dado que en la actualidad existe una confusión generalizada, de si esta competencia radica en un órgano de carácter Judicial (Juez de lo Civil) o si la misma se halla consagrada en un órgano administrativo (Municipio de Cuenca). De esta forma, el primer capítulo trata de identificar nociones y conceptos básicos, así como el análisis de instituciones tanto de Derecho Público cuanto de Derecho Privado, que nos servirán de medio para la fundamentación teórica de esta investigación. En cuanto al segundo capítulo, realizaremos un análisis del Ordenamiento Jurídico Ecuatoriano en cuanto a nuestro objeto de estudio, es decir, los bienes mostrencos así como su regulación jurídica en los distintos cuerpos normativos. Finalmente el tercer capítulo, consiste en un análisis de casos prácticos tanto de sentencias judiciales, como de un acto administrativo, que nos servirán de apoyo para afianzar los argumentos de nuestra conclusión final | es_ES |
| dc.description.abstract | The present work, has the aim to determine which is the competent organ to grant the securitization and the consequent domain of the vacant property in Cuenca City, inasmuch as in nowadays a general confusion exists about if this competence lies in a judicial organ, (Civil Judge) or in an administrative organ (Municipality of Cuenca). Therefore, the first chapter tries to identify basic concepts and notions, besides of the analysis of Institutions of PublicLaw, as well as Private Law, that will serve us to the theoretical fundamentation of this investigacion, as well as to outline our final conclusion. The second chapter, has the objective to analyze the ecuadorian legal system about our subject of study, is to say vacant property and the legal regulation in the different regulatory bodies. Finally, the third chapter consists in an analysis of practical cases as judicial sentences and anadministrative act, that will support us in order to strengthen our final thesis. | es_ES |
